By commissioning me, you agree to the terms as stated below:
Failure to read the Terms of Service before commissioning means you retract the rights to use, own or purchase commissions.
This is considered breaking the ToS.
I would not be held responsible for any complications.
Terms of Service
When purchasing a commission, you are buying partial rights to the art.
By purchasing you agree to not resell the art for profit
The art would be for personal use only unless agreed otherwise*
You cannot in any way sell the art to gain profit
*Personal Use is, but not limited to:
Art Posted in Character Galleries, Icon use, Graphics or social media
Anything outside of these boundaries is not considered personal use
Payment
All commissions must be paid after the sketch is approved
Currency that is accepted are USD and DA Points
If USD, it can be paid through Paypal or Venmo through invoice
If DA Points, they MUST be paid through the commissions widget
Payment plans are accepted for $40 and up
A Deposit of 25% is required for payment plans
The commissioned art does not belong to you until payment is completed
Process
No MAJOR changes allowed after the approved sketch.
Major changes are such as, but not limited to:
Full pose change, Added body parts, Full character change.
Small changes are free as long as in sketching stage.
Minimum changes require subcharge such as, but not limited to :
Outfit Change, Hand pose, Expression Change, or accessory added.
Wips are given frequently if asked
Commission time frame can range from 1 day to 1 week depending on:
Wait-list, Complexity, Supply Runs (Physical Art only) , Health or Holiday
If anything changes, you will be notified.
Copyright/usage policy
I, the artist, hold the rights to the commissioned artwork, not the commissioner.
Therefore, I am allowed to use the art to promote myself on anyplace or site as well as post it anywhere.
The commissioner, you, are allowed to:
Use the art for personal use unless stated otherwise.
Use the art to promote yourself WITH proper crediting.
If you break the policy in any way, you release all rights you have to the art.
The following is considered copyright infringement:
Reproducing / using copyrighted art for profit
Taking credit for the artwork
Removing signature / watermark
Purchasing commercial rights to artwork would be 400% of the original price.
With purchasing the commercial rights you can:
Use the artwork for album covers, posters, any merchandise, change it and use it to promote your brand.
Credit is still required
Canceling / Refund / Charge back Policy
I hold the right to refuse or cancel any commission at any time.
Money would be refunded with cancellation of commission.
You have no right to cancel or demand a refund under any circumstances after payment is received.
HOWEVER,
I can issue a refund if it is direly needed, provided you, the commissioner, provide proof.
If money has not been sent yet, the commissioner has the right to cancel the commission before sketching phase.
If you file a charge back against me, you extinguish your rights to everything that I, the artist, had created for you and everything would be retracted.
You would be blacklisted from ever commissioning me again
Your username would be posted on a beware/blacklist post so others can watch out for you
I can, and will, file a complaint and have the right to the money owed to me.
Any of the ToS can be changed if discussed with me, before the commission.
Disclaimer
If the commissioner, you, have not read the ToS thoroughly, I am not responsible for your overlook. I cannot be held responsible if the money is needed if issued a charge back. Tracing my artwork is not allowed and breaks ToS.
